3. Eligibility and Customer Accounts

Customers must have the legal capacity to enter into a purchase agreement under the laws applicable in their country of residence.

Customers may purchase products as guests or, where available, through a registered customer account.

You agree to provide accurate, complete and up-to-date information when placing an order or managing an account.

You are responsible for maintaining the security of the email account and authentication methods used to access your customer account.

If you believe your account has been accessed without authorisation, please contact us.

You must not transfer, sell or misuse your customer account.

4. Products and Product Information

Strolee Carts Europe offers shopping carts, pet transport accessories, personal shopping accessories, product bundles and related products.

We make reasonable efforts to ensure that product descriptions, specifications, dimensions, prices, images and availability information are accurate and up to date.

However, product colours and visual details may vary slightly depending on the screen or device used.

Measurements and weights may be approximate and subject to reasonable manufacturing tolerances.

Customers should consult the relevant product descriptions, assembly instructions, safety notices, compatibility information and recommended weight limits before use.

Products must be assembled and used in accordance with their intended purpose and the applicable instructions.

We may update product descriptions, improve specifications or discontinue products without prior notice. Such changes do not affect orders already accepted or applicable consumer rights.

5. Orders and Contract Formation

Placing an order constitutes an offer to purchase the selected products.

Before confirming an order, customers can review the selected products, quantities, delivery information, payment method and total price.

After submitting an order, customers will receive an electronic acknowledgement or order confirmation.

We may contact customers if additional information is required or if an unexpected problem affects fulfilment.

Orders may be declined or cancelled for legitimate reasons, including product unavailability, suspected fraud, payment failure or an obvious pricing error, subject to applicable law.

If an order is cancelled after payment has been collected, we will refund the amount due in accordance with applicable law.

Customers wishing to amend or cancel an order should contact us as soon as possible.

We will assist whenever the fulfilment status permits.

Nothing in this section restricts statutory rights relating to order cancellation, delayed delivery, non-conforming goods or withdrawal from distance contracts.

6. Prices, VAT and Currency

Prices displayed to consumers on our website include applicable Value Added Tax (VAT) and other mandatory taxes.

Prices are generally displayed in euros (EUR).

The VAT rate applicable to a purchase may depend on the customer's delivery country and relevant tax regulations.

Any applicable shipping charges and other mandatory costs will be clearly communicated before the customer confirms the order.

The total amount payable will be displayed during checkout.

For deliveries outside the European Union, additional customs duties, import taxes or clearance charges may apply. Where relevant, information about such costs and the party responsible for them will be provided in accordance with applicable law.

We reserve the right to modify prices and promotions without prior notice. Changes do not affect orders already accepted.

7. Promotions, Discounts and Bundles

From time to time, Strolee Carts Europe may offer promotional discounts, special prices, product bundles, complimentary accessories or free shipping.

Promotions may be subject to specific conditions, eligibility requirements, validity periods and stock availability.

These conditions will be communicated in the relevant promotional materials.

Unless expressly stated otherwise, promotional offers cannot be combined.

Discount codes must be used in accordance with their published conditions.

Products purchased during promotions, sales or final-sale campaigns are not automatically excluded from returns.

The statutory right of withdrawal, legal guarantee of conformity and other mandatory consumer rights continue to apply to promotional purchases.

Our voluntary 30-day return policy also applies to eligible promotional purchases, subject to its published commercial conditions.

Where a purchase includes a complimentary product or promotional bundle, any return arrangements will be handled in accordance with the promotion's disclosed terms and applicable consumer law.

8. Payments and Payment Security

Available payment methods are displayed during checkout.

Payments are processed through Shopify Payments or other authorised payment service providers made available through our store.

Payment information is handled using the security systems of the relevant payment providers.

Customers must ensure that they are authorised to use their selected payment method.

We do not intentionally collect or store complete payment card details through our customer service channels.

Payment authorisation, confirmation and applicable security checks may be required before an order is processed.

Refunds are normally issued using the original payment method, unless the customer expressly agrees to another method and no additional refund-related charges are imposed.

9. Shipping and Delivery

Orders are processed and shipped in accordance with the delivery information provided during checkout and any applicable shipping conditions communicated on our website.

Delivery availability, shipping costs and estimated delivery times may vary depending on the destination, selected delivery service, stock availability and operational circumstances.

Estimated delivery times are provided for guidance and do not constitute an unconditional guarantee of delivery on a particular date, unless a specific delivery commitment has been agreed.

Unless a different delivery period has been agreed, goods will be delivered within the timeframe required by applicable consumer law.

If delivery cannot take place within the agreed or legally applicable period, customers retain their statutory rights regarding delayed or failed delivery.

Customers are responsible for providing a complete and accurate delivery address.

If a parcel is delayed, lost or damaged during transport, please contact our customer service team so that we can investigate and provide an appropriate solution.

10. Transfer of Risk

For consumer purchases, the risk of loss or damage to goods generally remains with Strolee Carts Europe until the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.

An exception may apply where the customer independently commissions a carrier that was not offered by Strolee Carts Europe, in accordance with applicable law.

Nothing in these Terms limits the seller's legal responsibility for delivery or the customer's statutory rights in the event of loss or damage.

11. Statutory Right of Withdrawal

Consumers purchasing products online generally have a statutory right to withdraw from the purchase contract within 14 calendar days, without providing a reason, subject to exceptions established by applicable law.

For purchases of physical goods, the withdrawal period normally begins when the customer, or a designated third party other than the carrier, takes physical possession of the goods.

Where goods forming part of one order are delivered separately, the withdrawal period normally begins upon receipt of the last item.

Any longer withdrawal period required by applicable law remains available.

To exercise this right, customers must communicate a clear statement of their decision to withdraw before the applicable deadline.

This can be done by emailing:

connect@stroleecarts.eu

Customers may also use our Contact page.

The notification should preferably identify the customer, order number and products concerned to help us process the request efficiently.

A particular form, return reference or prior approval is not required to exercise a statutory right of withdrawal.

The customer may use a statutory model withdrawal form where available, but its use is not compulsory.

After notifying us of withdrawal, the customer must return the goods without undue delay and no later than 14 days after communicating the withdrawal decision, unless we have offered to collect them.

The deadline is met if the goods are sent before the 14-day return period expires.

Consumers may inspect and test products to the extent reasonably necessary to establish their nature, characteristics and functioning, as they would normally be able to do in a physical shop.

Any liability for diminished product value resulting from handling beyond what is necessary for that purpose is subject to applicable consumer law.

The statutory right of withdrawal is not conditional upon retaining unopened original packaging, except where a specific legal exception applies.

Our voluntary 30-day return policy does not replace, shorten or restrict this statutory right.

12. Voluntary 30-Day Return Policy

In addition to statutory consumer rights, Strolee Carts Europe offers a voluntary commercial return policy for eligible products.

Under this policy, customers may request a voluntary return within 30 days of the purchase date.

This is an additional commercial benefit and is separate from the statutory right of withdrawal.

The voluntary 30-day period is calculated from the purchase date, whereas the statutory withdrawal period is generally calculated from receipt of the goods.

If the applicable statutory withdrawal period expires after the voluntary 30-day period, the statutory right remains available in full.

This includes situations where the product is delivered after the voluntary 30-day period has already expired.

For a voluntary return, products should generally:

  • Have been tested indoors only.

  • Remain in new, resalable condition.

  • Include their original packaging.

  • Retain their original tags and safety information.

  • Include all relevant accessories, components and documentation.

These conditions apply to the additional voluntary commercial return policy.

They do not restrict the inspection permitted under statutory withdrawal rights or the customer's rights concerning incorrect, damaged, defective or non-conforming goods.

Promotional, sale and final-sale purchases are not automatically excluded from returns.

Statutory exceptions apply only where legally permitted.

Further details are provided in our Refund & Return Policy:

https://stroleecarts.eu/pages/refund-return-policy

13. How to Request a Return

To request a return, customers should contact Strolee Carts Europe by email:

connect@stroleecarts.eu

Customers may also use our Contact page:

https://stroleecarts.eu/pages/contact

Please provide your order number and identify the product you wish to return.

We recommend contacting our customer service team before dispatching the product so that we can provide the applicable return instructions.

Our authorised return address is:

Strolee Carts Europe
PFS, LDA

Calçada Conde de Tomar, 33B
1495-201 Cruz Quebrada
Portugal

VAT / Tax Number: PT 513471510

Customers should contact us for practical instructions before arranging a return.

However, the exercise of a statutory right of withdrawal does not depend on prior authorisation, approval, a return reference or the use of a particular form.

14. Return Conditions and Handling

For voluntary returns under our additional 30-day commercial policy, products should meet the conditions described in Section 12 and in our Refund & Return Policy.

Products should be appropriately packaged for transport to avoid unnecessary damage.

Normal inspection of a product does not result in an automatic penalty.

We do not impose automatic restocking or servicing fees.

Any assessment of diminished product value or excessive handling must comply with applicable consumer law.

Customers exercising their statutory right of withdrawal may inspect and handle goods to the extent necessary to establish their nature, characteristics and functioning.

These statutory rights are not restricted by the additional conditions of the voluntary return policy.

15. Return Shipping Costs

For voluntary returns or statutory withdrawal because the customer has changed their mind, the customer is responsible for the direct return shipping costs only where legally permitted and properly disclosed before purchase.

No fixed return shipping charge is imposed by our Refund & Return Policy.

Where the customer has not been properly informed of an obligation to pay return shipping costs, the applicable consumer protection rules will apply.

For incorrect, defective, damaged or non-conforming goods, Strolee Carts Europe will bear the return or remedy costs required by applicable consumer law.

Where required by law, repairs, replacements and other statutory remedies will be provided without charge to the consumer.

16. Refunds and Exchanges

Refunds are processed in accordance with our Refund & Return Policy and applicable consumer legislation.

For a valid statutory withdrawal, we will reimburse the payments required by law without undue delay and no later than 14 days after being informed of the customer's decision to withdraw.

Where permitted by law, we may withhold reimbursement until we receive the returned goods or the customer provides evidence that the goods have been sent back, whichever occurs first.

Refunds will normally be made using the original payment method unless the customer expressly agrees otherwise.

No refund-related charges will be imposed on the customer for exercising statutory withdrawal rights.

We do not deduct payment processing fees from legally required refunds.

Where required by law, refunds include the standard original delivery charge.

Any additional amount paid for a delivery option more expensive than the least expensive standard delivery offered need not be reimbursed where permitted by law.

For statutory withdrawal, we do not retrospectively deduct outbound shipping costs from orders originally sold with free shipping.

For returns under the additional voluntary 30-day policy, the applicable commercial conditions are those published in our Refund & Return Policy, without prejudice to statutory consumer rights.

Customers may request an exchange as an alternative to a refund where a suitable replacement product is available.

An exchange cannot be imposed where the customer is legally entitled to a refund.

17. Damaged, Incorrect or Non-Conforming Goods

If a product arrives damaged, is incorrect or does not conform to the purchase contract, customers should contact Strolee Carts Europe as soon as reasonably possible.

We will assess the issue and provide the remedy required by applicable consumer law.

Depending on the circumstances and applicable legislation, remedies may include repair, replacement, an appropriate price reduction or termination of the contract with reimbursement.

These rights are independent of the voluntary 30-day return policy.

Customers are not required to meet the commercial conditions for voluntary change-of-mind returns when exercising their statutory rights concerning non-conforming goods.

The costs of remedies for non-conforming goods will be handled in accordance with applicable consumer legislation.

18. Legal Guarantee of Conformity

Products sold to consumers benefit from the mandatory legal guarantee of conformity provided by applicable consumer protection legislation.

Under Portuguese law, new movable consumer goods generally benefit from a legal guarantee of conformity covering defects or non-conformities that become apparent within three years from delivery.

Consumers purchasing from other European Union countries retain any mandatory protections applicable to their purchases.

Depending on the circumstances and applicable legislation, consumers may be entitled to repair, replacement, an appropriate price reduction or termination of the contract.

The exercise of these rights is subject to the conditions and procedures established by law.

Statutory remedies must be provided without charge where required by applicable legislation.

The legal guarantee exists independently of our voluntary return policy and any additional commercial warranty.

Nothing in these Terms excludes, reduces or shortens statutory guarantees or remedies.

19. Strolee Commercial Warranty

In addition to statutory consumer rights, eligible Strolee products may benefit from our two-year commercial warranty, as described in our Strolee Warranty policy.

The commercial warranty provides coverage for eligible design or manufacturing defects for two years from the purchase date.

Covered repairs are provided free of charge in accordance with the published warranty conditions.

Depending on the defect, warranty support may include the supply of replacement components, such as wheels or a frame.

This commercial warranty is separate from and additional to the statutory legal guarantee of conformity.

It does not replace, restrict or shorten any mandatory consumer rights.

The expiry of the commercial warranty does not terminate statutory guarantee rights that remain applicable.

Customers requiring warranty support should contact us before sending any product so that we can provide the appropriate instructions.

Full details are available at:

https://stroleecarts.eu/pages/strolee-warranty

20. Product Safety and Responsible Use

Customers must follow the assembly instructions, safety notices, compatibility guidance and weight limits provided with each product.

Products should not be modified or used in ways inconsistent with their intended purpose.

Pet transport accessories must be used only with compatible products and in accordance with the applicable instructions.

Customers should inspect products before use and discontinue use where damage or unsafe conditions are identified.

If a product appears defective or unsafe, customers should contact our support team.

These recommendations do not limit statutory consumer rights or the seller's responsibilities under applicable product safety legislation.

21. Intellectual Property

The website, trademarks, logos, product names, designs, images, videos, written materials and other content displayed through our services are owned by Strolee Carts Europe, its licensors or their respective rights holders.

These materials are protected by applicable intellectual property legislation.

Customers may access and use the website for lawful personal and shopping-related purposes.

Unauthorised commercial reproduction, distribution, modification or exploitation of protected website materials is prohibited, except where permitted by applicable law or authorised by the relevant rights holder.

Purchasing a product does not transfer intellectual property rights associated with its design, branding or technology.

22. Third-Party Services and Shopify

Our online store uses Shopify and may integrate other third-party services, including payment processors, shipping operators, customer support tools and marketing services.

Such services may be governed by their own terms and privacy notices.

Strolee Carts Europe remains responsible for its obligations as the seller of products purchased through this store.

Shopify and other service providers are not the contractual sellers of Strolee products unless expressly stated otherwise.

Nothing in this section excludes responsibilities imposed on us by applicable law.

23. Privacy and Personal Data

The collection, use and processing of personal data are governed by our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR).

We may process information necessary to manage orders, deliver products, communicate with customers, provide support, prevent fraud and comply with legal obligations.

Because our store operates using Shopify, certain personal data may be processed by Shopify and authorised service providers, as described in our Privacy Policy.

Customers may exercise their applicable data protection rights by contacting us.

Further information is available in the Privacy Policy published on our website.

24. Customer Reviews and Feedback

Customers may submit product reviews, feedback, suggestions or other content through the channels provided by Strolee Carts Europe.

Submitted content must be lawful, accurate to the best of the customer's knowledge and respectful of the rights of others.

Customers must not submit fraudulent reviews, misleading statements, unlawful materials or content that infringes intellectual property rights.

By submitting content for publication, customers grant Strolee Carts Europe a non-exclusive licence to display, reproduce and use that content in connection with the operation and promotion of its products and services, subject to applicable law and privacy rights.

We may moderate or remove content that violates these Terms or applicable legislation.

25. Errors, Inaccuracies and Website Availability

Despite our efforts, occasional errors or inaccuracies may occur in product descriptions, pricing, promotions, availability or other website information.

We reserve the right to correct such errors and update information where appropriate.

If a material error affects an order, we will contact the customer and apply a solution consistent with applicable consumer law.

Where an order is cancelled and payment has been collected, the amount legally due will be refunded.

We make reasonable efforts to maintain the security, availability and accuracy of our website and services.

However, temporary technical interruptions or maintenance may occur.

We will not unilaterally impose additional charges on an accepted order without the customer's agreement where required by law.

26. Prohibited Uses

Customers must not use our website or services to:

  • Commit fraud or other unlawful activities.

  • Infringe intellectual property or privacy rights.

  • Transmit malicious software or interfere with website security.

  • Attempt unauthorised access to accounts, payment systems or administrative functions.

  • Submit knowingly false or misleading information.

  • Engage in activities that materially disrupt the lawful operation of our services.

We may take proportionate measures to prevent misuse, including restricting access where necessary and legally permitted.

Such measures do not affect existing purchase contracts or mandatory consumer rights.

27. Limitation of Liability and Events Beyond Our Control

To the extent permitted by applicable law, Strolee Carts Europe is not responsible for losses resulting solely from circumstances outside its reasonable control.

Events beyond our reasonable control may include natural disasters, severe weather, transport disruptions, major infrastructure failures, governmental restrictions or other extraordinary circumstances.

Where such events affect an order, we will inform the customer when reasonably possible and seek an appropriate solution.

Customers retain their statutory rights concerning delayed or failed delivery, refunds and contract termination.

Nothing in these Terms excludes or limits liability for matters that cannot lawfully be excluded, including applicable consumer guarantees, product liability obligations, fraud, intentional misconduct or other mandatory legal responsibilities.

Any contractual limitation of liability applies only to the extent permitted by the laws governing the transaction.

28. Governing Law and Consumer Jurisdiction

These Terms are governed by Portuguese law, subject to applicable European Union legislation and mandatory consumer protection provisions.

Where a customer resides in another European Union country, this choice of law does not deprive that customer of mandatory consumer protections applicable under the laws of their country of habitual residence.

Disputes may be brought before the courts having jurisdiction under applicable Portuguese and European Union rules.

Nothing in these Terms requires consumers to waive their right to bring proceedings before a court competent under mandatory consumer jurisdiction rules.

29. Complaints and Alternative Dispute Resolution

Customer satisfaction is important to Strolee Carts Europe.

If you have a complaint about an order, product or service, please contact us:

Email: connect@stroleecarts.eu

We will review the matter and seek an appropriate resolution.

Consumers may also use competent Alternative Dispute Resolution (ADR) mechanisms in accordance with applicable Portuguese and European Union legislation.

For disputes within its jurisdiction, consumers may contact:

Centro de Arbitragem de Conflitos de Consumo de Lisboa

https://www.centroarbitragemlisboa.pt

Information about other competent consumer dispute resolution bodies is available from the Portuguese Directorate-General for Consumer Affairs:

https://www.consumidor.gov.pt

Consumers may also submit complaints through Portugal's official Electronic Complaints Book:

https://www.livroreclamacoes.pt

These mechanisms do not restrict consumers' rights to seek remedies through the competent courts.

30. Languages and Translations

These Terms of Service may be made available in several languages for the convenience and understanding of our customers.

We aim to ensure that translations accurately reflect the applicable contractual conditions.

In the event of inconsistencies between language versions, the Terms will be interpreted in accordance with applicable law and the mandatory rights of the consumer.

No language-precedence provision may deprive a consumer of mandatory protections or information rights applicable in their country.

31. Changes to These Terms

We may update these Terms to reflect changes in our business operations, services, applicable legislation or website functionality.

The most recent version will be made available on our website.

Material changes will be communicated where required by law.

Updates will not retrospectively alter contractual rights and obligations arising from orders already accepted, except where permitted by law or agreed with the customer.
